My Equity Transition

Probate property options

Probate property is three separate questions

Inheriting a home with equity usually raises three questions at once: who owns the property under state law and court process, what the servicer will do with the existing note, and whether heirs should retain, sell, or refinance. This guide orders those questions so you build a fact file before anyone recommends a loan product.

Probate timelines and lender requirements vary by state, servicer, and whether the property passed through probate or by survivorship. This site does not state how long your case will take — it helps you list documents and questions for estate counsel and the servicer.

Property owned jointly with a right of survivorship or as tenants by the entirety passes directly to the surviving owner and is not a probate asset.

Under Regulation X, a confirmed successor in interest is a successor whose identity and ownership interest in property securing a covered mortgage loan have been confirmed by the servicer.

Federal due-on-sale exemptions address exercise of the due-on-sale option; they do not state that an exemption cancels the mortgage debt, releases a borrower, or removes the lender's lien.

Step 1 — Ownership and court process

Start with the death certificate, will or intestacy status, and recorded deed. Property owned jointly with right of survivorship or as tenants by the entirety may pass outside probate — New York Courts describe that pattern for survivorship property. New Jersey uncontested probate matters go through the county surrogate. Ask your estate attorney whether your property is a probate asset or transferred by operation of law.

If multiple heirs inherit, list each heir's ownership share as counsel describes it. Disagreement among heirs is common; the retain-versus-sell calculator gives shared arithmetic when everyone enters the same assumptions.

Step 2 — Servicer and successor status

The note may list borrowers who are deceased. Regulation X defines a confirmed successor in interest as someone whose identity and ownership interest have been confirmed by the servicer. Confirmation affects servicing access — it does not by itself decide assumption, refinance, or sale.

Use the successor and servicer questions guide to track correspondence. Ask the servicer what documents they require before discussing assumption or payoff. Do not treat a comfort letter as a liability decision.

Step 3 — Retain, sell, or refinance paths

Retain: an heir who wants to keep the home may pursue assumption if allowed, or refinance to pay off other heirs and retire the old note. Enter payments and DTI thresholds in the equity transition calculator — no eligibility verdict from this site.

Sell: heirs who prefer liquidity model sale price, lien payoffs, and transaction costs in the retain-versus-sell section, then compare cash after costs to retain scenarios.

Assumption vs refinance tradeoffs are covered in the dedicated guide. Federal due-on-sale exemptions may apply to certain transfers after death; exemptions do not cancel debt or release borrowers — ask the servicer what continuing the loan requires.

Bring professionals the same permalink

Estate attorneys answer ownership and probate process. Servicers answer note continuation, assumption, and payoff. Loan officers answer refinance structure with your entered numbers. This site keeps the arithmetic and document list consistent across those calls.

Frequently asked questions

Does every inherited home go through probate?
Not always. Survivorship deeds and certain joint ownership forms may pass outside probate. Ask your estate attorney whether your property is a probate asset.
Can heirs assume the deceased borrower's mortgage?
Assumption requires lender approval and a note that allows it. Ask the servicer what documents they need — do not assume the loan transfers automatically.
What if heirs disagree on keeping the house?
Use the retain-versus-sell calculator with shared entered assumptions, then bring the permalink to mediation or counsel. This site does not pick a winner.
